TERMS AND CONDITIONS
The general conditions of sale set out below concern the purchase of tailored products by electronic means.
The tailored product is handcrafted by hand in all the parts that make it up, this is a guarantee of exclusivity and quality.
The stipulated sales contract will be governed and interpreted in accordance with Italian law.
1. Introduction
1.1. The sale of "AMBRA CASTELLO" brand products concluded remotely through this site (hereinafter referred to as the "Website") is governed by the following General Conditions of Sale.
The products offered on the Site are sold directly by AMBRA CASTELLO. AMBRA CASTELLO is a company under Italian law, with registered office in Via Umberto I, 117 - 94018 Troina (EN) - Italy, VAT number 01270860867 - N.REG. CSTMBR93C57L219Z - Registered at the CCIAA of Palermo and Enna.
1.2. The languages used for the conclusion of the sales contract through this website are: Italian and English.
1.3. These General Conditions of Sale are published on the Website in order to allow their knowledge and storage and reproduction by the Customer in accordance with current legislation.
1.4. The purchase of products is governed exclusively by the General Conditions of Sale published on the Website and in force at the time of purchase.
AMBRA CASTELLO reserves the right to make changes and / or additions to these General Conditions of Sale at any time.
Any changes and / or additions will be effective only in relation to purchases made after the date of publication of the new version of the General Conditions of Sale.
2. Product availability
2.1. The Customer acknowledges that the products offered by AMBRA CASTELLO on the Website (hereinafter referred to as the "Products") are numerically limited and is therefore aware that AMBRA CASTELLO will have to check their availability at the time of purchase.
2.2. Problems may occasionally occur in connection with the availability of certain Products. In these circumstances, AMBRA CASTELLO will inform the Customer promptly (and in any case within the terms specified below) by e-mail of the cancellation of his order.
In the case of only partial availability, the customer will be informed. Therefore, the Customer agrees to receive only the available Products and to put into production, where possible, the product (s) not currently available.
2.3. AMBRA CASTELLO reserves the right to change the items offered for sale on the Website at any time, without notice.
3. Purchase procedure
3.1. Each Product offered for sale on the Website can be viewed through a special link that allows you to view the photographic images of the article, the unit price, the colors and the different sizes (if any).
3.2. The Products chosen by the Customer will be included in a special section (hereinafter referred to as the "Cart").
The description of the Products, including the measurements or sizes (if any), together with one or more photographic images in digital format, which allow a correct representation of the Products, will be included in the Customer's Cart.
3.3. Although AMBRA CASTELLO constantly adopts measures to ensure that the photographs shown on the Website faithfully reproduce the original products, some variations are always possible due to the technical characteristics and color resolution with which the device used by the customer is equipped. Consequently, AMBRA CASTELLO will not be responsible for any non-compliance of the graphic representations of the Products shown on the Website if due to the aforementioned technical reasons.
3.4. To view the selected Products and the overall price of the purchase order, you must access the Cart page.
The Customer, before confirming his order, is required to verify the accuracy of the contents of the Cart and to complete the purchase form based on the instructions provided on the Website.
3.5. The purchase procedure ends when the customer selects the appropriate final order confirmation button thus validating his purchase, which will be sent directly to AMBRA CASTELLO.
After selecting the Purchase Button, the content of the Order can no longer be changed by the Customer.
3.6. Before confirming the Order, the Customer must declare that he has read and accepted these General Conditions of Sale. At the end of the purchase procedure, the Customer should save or print the General Conditions of Sale.
3.7. Each Order Proposal and Customer data necessary for the purchase will be archived by AMBRA CASTELLO for the period of time and in compliance with the conditions established by current legislation on respect for privacy.
3.8. The Customer is aware of being responsible for the correctness and truthfulness of all data entered on the Website or otherwise used during the purchase phase.
3.9. The Customer is also aware of the fact that on the Website he also has the possibility of requesting the production of one or more Products. The customer is required to inquire about the production times, before proceeding with the purchase, by sending an email to the address amra@ambracastello.com.
The Customer acknowledges that these Products are not yet available for shipment at the time of sending the purchase order. The Products that can be put into production by the Customer are clearly identified and reported on the Website in the description of each product.
3.10. The Customer acknowledges and accepts that, if he requests the production of one or more Products, he is required to pay a deposit by purchasing a Gift VOUCHER equal to at least 30% of the final price of the product.
3.11. Once the production of the Products is completed, AMBRA CASTELLO will inform the Customer via email, who will proceed with the payment of the remaining part of the final price of the Products. To proceed with the balance, the customer must go to the website www.ambracastello.com and insert the products in the cart. When proceeding with the purchase order, a "I have a coupon" item will appear in the upper right corner where you can enter the code of the Gift VOUCHER purchased for the payment of the deposit.
3.12. AMBRA CASTELLO reserves the right to proceed with the shipment only after receiving the balance of the full amount of the Products.
3.13. All further details relating to payment and delivery are specified in the respective sections below.
3.14. The Customer acknowledges and accepts that, except as expressly provided herein for the Products put into production, the other clauses of these General Conditions of Sale also apply to the Products put into production.
4. Conclusion of the contract
4.1. After placing the Order, the Customer will receive an email in which AMBRA CASTELLO will communicate that he has received the Order. This email cannot be understood as acceptance of the Order. Acceptance of the Order by AMBRA CASTELLO and the conclusion of the contract will take place in accordance with the provisions of point 4.2 below.
4.2. The contract stipulated between AMBRA CASTELLO and the Customer must be considered concluded when the Customer receives one or more confirmation emails from AMBRA CASTELLO (hereinafter referred to as "Confirmation Email").
The Confirmation Email will be sent to the address indicated by the Customer in the purchase form. Through the email, direct communication will be initiated with the customer, to assist him during his shopping experience on the www.ambracastello.com website. The email will contain the confirmation of stock or production of the Products and the summary of the conditions of the purchase itself, such as: the description of the Products and the main characteristics of the same, the total price of the order, including any shipping costs , production and shipping times, information on after-sales assistance services, on the existence of the right of withdrawal and on the relative methods of exercise.
4.3. AMBRA CASTELLO reserves the right not to accept the Order issued by a Customer in the following cases:
a) unavailability of the Products included in the Order;
b) existence of a legal dispute between AMBRA CASTELLO and the customer relating to a previous order;
c) if the Customer on previous occasions has committed violations of the General Conditions of Sale or has not fulfilled his obligations;
d) if it has emerged that the Customer purchases the Products for the purpose of reselling or selling them for commercial or professional purposes;
e) if the Customer has been involved in or is suspected of illegal or fraudulent activity.
In the aforementioned cases, AMBRA CASTELLO will notify the Customer by e-mail, within 30 (thirty) days from the date of effective receipt of the Order, of the possible cancellation of the orders received. In this case, no Order shall be considered accepted by AMBRA CASTELLO and no contract shall be considered concluded between AMBRA CASTELLO and the Customer.
5. Price and Method of Payment
5.1. These prices will be indicated in Euros (EUR).
5.2. The total amount of the price shown in the Cart includes any shipping costs, which will be indicated separately.
In any case, AMBRA CASTELLO will ask the express consent of the customer for any further additional cost.
5.3. AMBRA CASTELLO reserves the right to change the prices of the Products offered for sale on the Website at any time and without notice.
5.4. AMBRA CASTELLO only accepts credit cards and other payment methods expressly indicated on the Website.
5.5. For the purposes of payment by credit card, the Customer confirms and guarantees that he is the holder of the credit card used for the purchase and the correctness of all the data relating to it, entered during the purchase, such as: the number, the date expiry date and, if necessary, the security code.
5.6. For the purposes of payment through other payment service providers, the Customer confirms and guarantees that he is the owner of the account used for the purchase.
5.7. The shipment of the purchased Products will be made only after the payment of the amount due by the Customer has been successful.
In the event that, for any reason, the debit of the amounts due by the Customer proves impossible, the sales process will be automatically canceled and the sale canceled, as per communication that will be sent to the Customer.
5.8. In the event that one or more Products are unavailable and the Customer has decided not to cancel the order in full, only the price and any shipping costs relating to the only Products available will be charged.
6. Delivery
6.1. Customers will receive the Products as soon as they are ready for shipment. The Products will be shipped to the address indicated by the Customer in the Order.
6.2. For security reasons, AMBRA CASTELLO will not process any order addressed to a post office box or accept any order in which it is not possible to identify the physical person to whom the order is sent and its address.
6.3. In cases where the Customer is charged for shipping costs, these will be expressly indicated, separately from any other cost or expense, at the conclusion of the order compilation procedure and prior to the selection of the Payment Method and conclusion of the Order by of the customer.
6.4. AMBRA CASTELLO will have to deliver the Products purchased during the estimated delivery period agreed with the Customer.
6.5. If AMBRA CASTELLO does not deliver the Products ordered within the aforementioned period, the Customer must ask AMBRA CASTELLO to make the delivery within an additional period appropriate to the circumstances, in accordance with current legislation.
The right of the Customer to immediately terminate the contract is reserved if the ordered Product is not delivered within the additional term indicated.
6.6. AMBRA CASTELLO gives the Customer the possibility to divide the Order into multiple shipments, based on the availability of the Products for delivery, unless the Customer himself prefers to receive the entire Order in one shipment.
AMBRA CASTELLO will be able to charge the price to the Customer separately for only the Products actually shipped or in a single solution.
6.7. At the time of shipment of the purchased Product, the Customer will receive an e-mail at the address indicated in the Order. This e-mail will contain a shipment tracking code and an exclusive link that will allow monitoring of delivery in real time.
The AMBRA CASTELLO Customer Service will provide assistance for any possible delivery problems. The Customer can contact AMBRA CASTELLO Customer Service by e-mail at the address: ambra@ambracastello.com.
6.8. As an alternative to delivery by courier, the Customer may request to collect the Products purchased directly at the AMBRA CASTELLO company headquarters in via Umberto I, 117 - 94018 Troina (EN) - Italy. If the Customer does not collect the Products within the term of 30 (thirty) days from the receipt of the e-mail with which he has been informed that the Product is available for collection, the sale can be canceled by AMBRA CASTELLO. In this case, the Customer will be notified by e-mail of the cancellation and will be promptly refunded of any amounts already paid.
6.9. The Customer will assume the risk of loss or damage to the Products only when the same, or a third party designated by him and different from the carrier, physically enters into possession of such Products.
In the event that, on the contrary, the loss or damage to the Product occurs before the material is delivered to the Customer or to a third party designated by him, AMBRA CASTELLO will refund the customer the amounts already paid.
7. Product conformity
7.1. At the time of delivery, the Products must be checked by the Customer in order to ascertain that they correspond to the ordered items and that they do not present production defects or lack of conformity.
7.2. In the event of production defects or lack of conformity, the Customer will have the right to restore, without charge, the conformity of the Product by repair or replacement, unless the remedy requested is objectively impossible or excessively expensive compared to the other.
If one of the hypotheses provided for by law occurs, the Customer may request a reasonable reduction of the price or the termination of the contract and the consequent reimbursement of the price paid. It is understood that the Customer forfeits this right if he does not report the lack of conformity to AMBRA CASTELLO within the term of 2 (two) years from the date on which the Product was delivered. In any case, AMBRA CASTELLO is responsible for the only conformity defects that occur within 2 (two) years from the delivery of the Product.
7.3. In order to report the presence of defects and defects of the Products and obtain one of the remedies listed above, the Customer can contact AMBRA CASTELLO at the addresses indicated in the following article 12.
8. Returns and refunds - Withdrawal
8.1. The Products can be returned or exchanged exclusively for manufacturing deficiencies and / or in the event that the chosen size does not go well. Once the product has been received and the package has been opened, immediately check the integrity of the purchased item and the correctness of the size.
8.2. The Customer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery or collection of the Products.
8.3. To exercise the right of withdrawal, the Customer must send a withdrawal request by sending an email to ambra@ambracastello.com, specifying the address, telephone number and the date chosen for the collection of the package, to be confirmed with the courier.
8.4. If the Customer follows the procedure referred to in the previous point, the courier designated by AMBRA CASTELLO will collect the package containing the returned Products at no charge to the Customer.
In the event that the Customer does not follow this procedure, the return costs and any liability for loss, theft, damage or delay in delivery will remain the responsibility of the Customer.
8.5. The Customer can also recover the address to which the Products must be returned by contacting AMBRA CASTELLO at the following e-mail address: ambra@ambracastello.com.
8.6. The Customer undertakes to return the Products for which he exercised the right of withdrawal without undue delay and, in any case, within 14 (fourteen) days from the date on which he communicated to AMBRA CASTELLO his decision to withdraw from the contract.
8.7. The Products must be returned in the same state in which they were delivered. The Customer must therefore ensure that the Products are intact and complete, never used, worn or damaged in any way, and that they are returned in their original packaging, accompanied by all the labels with which they were received. AMBRA CASTELLO will verify the packaging and the status of the individual Products returned, constituting the substantial integrity of the same essential requirement for exercising the right of withdrawal.
AMBRA CASTELLO reserves the right to refuse the return of those Products that are damaged, deteriorated, dirty or are in a state such as to imply, unequivocally, that they have been used for purposes other than the checks of the Customer strictly necessary to ascertain the nature and characteristics of the product purchased.
In case of refusal of the return, AMBRA CASTELLO will send a specific communication to the Customer and will not proceed to re-credit the price paid by the same, also reserving the right to request compensation for any damage attributable to the Customer's conduct.
8.8. The reimbursement of the price of the returned Products will be made by AMBRA CASTELLO without undue delay and in any case within 14 (fourteen) days from the date on which AMBRA CASTELLO came into possession of the Product on which the Customer requests to return.
In any case, AMBRA CASTELLO reserves the right to withhold the refund until it has received and verified the Product.
The aforementioned refund will be made by crediting the amount paid by the Customer to be carried out with the same payment method used for the purchase, unless the Customer has expressly agreed otherwise and on condition that he does not have to bear any cost as a consequence of the refund.
AMBRA CASTELLO will confirm the refund of the price by e-mail to the Customer.
8.9. AMBRA CASTELLO will not be required to reimburse the delivery costs of the Products if the Customer has expressly chosen a type of delivery other than the standard one offered by AMBRA CASTELLO.
9. Limitation of liability
9.1. Outside of cases of willful misconduct or gross negligence, AMBRA CASTELLO will not be liable in any way towards the Customer for indirect or consequential damages that may arise from the purchase of Products offered for sale on the Website.
10. Authenticity of products and intellectual property rights
10.1. AMBRA CASTELLO guarantees the authenticity and high quality of all the Products offered for sale on the Website.
10.2. The "Ambra Castello" brand, as well as all the figurative and non-figurative brands and more generally all the other brands, illustrations, images and logos present on the "Ambra Castello" products, on the related accessories and / or packaging, which are subject to registration or not, are and remain the exclusive property of AMBRA CASTELLO. The total or partial reproduction, modification, tampering or use of said trademarks, illustrations, images and logos, for any reason and on any medium, are absolutely prohibited.
11. Disputes
11.1. These General Conditions of Sale are governed by Italian law and will be interpreted on the basis of it, without prejudice to any other mandatory rule, more favorable to the Customer, applicable in the Country of habitual residence of the Customer.
11.2. In the event of a dispute arising from the interpretation and / or application of these General Conditions of Sale, the Court of the place of domicile or residence of the Customer will be competent, exclusively and without exception, if located in the territory of the Italian State. If the Customer's domicile or residence is located in a territory other than the Italian State, the Customer may, at his option, refer to the Court of his place of residence or domicile or the Court of Enna.
